Classes confused with class 25
- Class 35, advertising & business: Retail services. Class 25 protects the clothing; selling goods as a shop or online store, especially other brands’ products, is a class 35 service. Brands that manufacture and sell their own line often file both.
- Class 9, software & electronics: Protective clothing. Items whose purpose is protection, like fire-resistant clothing, bullet-proof garments and protective helmets, are class 9.
- Class 28, games & toys: Sports equipment. Gear essential to practising a sport, such as boxing gloves and ice skates, is class 28, while ordinary sports clothing like jerseys and gym wear stays in class 25.
- Class 10, medical devices: Medical garments. Operating-room clothing and orthopaedic footwear are class 10.
- Class 26, haberdashery: Fastenings and trimmings. Buckles, zippers, ribbons and other haberdashery for clothing are class 26, not part of the garment itself.
